Terms of Service

These Terms govern your use of the Vi3w service (the “Service”) operated by LabGL (“we”, “us”), including the rights and obligations of both you and us.
By creating an account or using the Service you agree to these Terms. If you do not agree, please do not use the Service.
Matters not covered here are governed by applicable law and commercial practice.
1. Definitions
- “Service” means our web-based platform for creating, publishing and viewing augmented reality experiences, together with related services.
- “User” means anyone who accepts these Terms, creates an account and uses the Service.
- “Visitor” means anyone who opens an AR experience through a published link or QR code, including without an account.
- “Workspace” means the unit in which a user manages content and members.
- “User Content” means everything you upload or create in the Service — 3D models, images, text and settings.
- “Library Models” means the shared 3D models we make available within the Service.
2. These Terms and changes to them
These Terms take effect when posted in the Service.
We may amend these Terms where permitted by law. We will announce any change in the Service at least 7 days before it takes effect, stating the effective date and the reason. Where a change is unfavourable or material to you, we will give at least 30 days' notice and also email the address registered to your account.
You may refuse a change and terminate your contract before the effective date. If you continue using the Service beyond that date without objecting, you are deemed to have accepted the change.
3. Accounts
You need an account, created with an email address or a Google account. Please give accurate information and keep it up to date.
We do not accept sign-ups from children under the age of 14.
You are responsible for your account and password. If you believe your account has been compromised, tell us immediately and follow our instructions.
One email address may hold only one account; you cannot use the same address for both email sign-up and Google sign-in.
4. The Service
We let you upload 3D models — or choose Library Models — assemble an AR experience, and publish it as a unique link and QR code.
The features and usage limits available to you depend on your plan.
We may add, change or discontinue features. Where a change is material and unfavourable to you, we will notify you in advance under §2.
The Service may be interrupted for scheduled maintenance, equipment work, or events beyond our control such as power or network failure. We will give advance notice where we reasonably can.
5. Your content
You keep all rights, including copyright, in your User Content. We claim no ownership of it.
You grant us the rights we need to run the Service — to store, copy, transmit and convert your content (for example, converting a model into a web-viewable format or generating thumbnails). This licence is limited to operating the Service and ends when you delete the content or close your account.
You confirm that you hold the rights needed for what you upload, and that it does not infringe anyone's copyright, trade marks or likeness rights.
6. AI authoring assistant
We may offer a feature that proposes settings for an AR experience from a written request. It runs only when you invoke it.
You decide whether to apply what the AI proposes. We do not warrant that its suggestions are accurate or suitable, and you are responsible for the results of applying them.
When you use the feature, your prompt and the settings and text of that experience are sent to an external AI provider. See our Privacy Policy for details.
Usage limits depend on your plan, and we may cap usage to prevent abuse.
7. Publishing and public access
Publishing an AR experience generates a unique link and QR code.
Anyone with the link can open it without signing in, and can therefore access the text, 3D models and settings it contains — including the coordinates of a location-based experience. Please do not publish material containing personal or confidential information.
Uploaded 3D models and images are likewise served from publicly reachable addresses.
You may unpublish at any time, which stops the link from working. We cannot control copies or screenshots already saved on a visitor's device.
8. Library Models
We provide shared 3D models so you can start quickly. Each model carries its own licence, shown together with author information in the Service.
You may use Library Models to build AR experiences within the Service. Where a licence requires attribution, you must comply with that condition.
You are responsible for any dispute or loss arising from your failure to observe a model's licence terms.
9. Plans and payment
The Service is offered on free and paid plans. Prices and limits are as shown on our pricing page.
Payments for paid plans are processed by Polar Software Inc. (the “payment provider”) acting as Merchant of Record. The payment provider therefore handles the sale, invoicing and taxes, and collects your payment details directly. We never store card numbers or other payment credentials.
Paid plans renew automatically each billing period until you cancel. You may cancel at any time before the next renewal; access continues until the end of the period you have already paid for.
We may change prices, with advance notice under §2. New prices apply from the first renewal after the announced effective date.
10. Withdrawal and refunds
Under Korean consumer law you may withdraw from a purchase within 7 days of receiving the contract documentation.
That right may be limited once the supply of digital content has begun. To address this, we offer a free plan so you can evaluate the Service before paying.
Where you could not use the Service for reasons not attributable to you, or where it differs from what was advertised or agreed, you may withdraw within 30 days of becoming aware (and within 3 months of supply).
Refunds are handled through the payment provider's process. The provider refunds requests made within 10 days for one-off payments, and within 30 days of the most recent renewal for subscriptions. Where the law grants you stronger rights, the law prevails.
To request a refund or withdrawal, contact support@vi3w.net. We will verify the request, process it through the payment provider and tell you the outcome.
11. What you must not do
When using the Service you must not:
- upload or publish content that breaks the law or infringes anyone's rights;
- use someone else's work without proper authorisation;
- post obscene, violent or discriminatory material, or content that defames or harasses others;
- register with false information or use another person's account without permission;
- exploit vulnerabilities, or generate excessive automated requests that disrupt the Service;
- reverse-engineer, copy or resell the Service, or provide it commercially to others without our prior consent;
- upload malware or use the Service to distribute it;
- infringe our intellectual property rights or those of a third party.
12. Intellectual property
The Service itself — including its software, design, trade marks and documentation — belongs to us or our licensors.
These Terms grant you a right to use the Service only. You may not copy, distribute or create derivative works from it without our prior written consent.
13. Termination and suspension
You may close your account at any time from the **Account** screen after signing in. We hold the account for 7 days and then close it automatically; you can cancel the request from the same screen during that period. If you cannot use that screen, contact support@vi3w.net and we will act within 10 days of your request and confirm the outcome.
Once termination takes effect, your account details and User Content are deleted as described in our Privacy Policy, and the share links and QR codes you published stop working. Content in a workspace shared with other members remains with that workspace, and ownership passes to another member.
We may restrict your use or terminate your contract if you breach §11 or otherwise materially breach these Terms, after giving notice. Where urgent action is needed we may act first and explain without delay afterwards.
You may object to any restriction or termination. If your objection is well founded, we will restore your access promptly.
14. No warranty
We do not warrant that the Service will be uninterrupted or entirely free of errors.
AR features depend on the visitor's device, operating system, browser, camera permission and lighting conditions. We do not warrant behaviour on any particular device or environment, and we recommend testing before an important campaign.
You are responsible for the content you publish and for the consequences of publishing it.
15. Limitation of liability
We are not liable for loss caused by events beyond our reasonable control, such as natural disaster, war, power failure or an outage at a telecommunications carrier.
Except where we act with intent or gross negligence, our total liability to you is limited to the fees you paid us in the three months before the loss arose. For services provided free of charge, we accept no liability except where the law provides otherwise.
Nothing in this section limits liability that cannot be limited by law, including liability for death or personal injury or for our intent or gross negligence.
16. Privacy
We protect your personal data in accordance with applicable law; our Privacy Policy explains how.
The Privacy Policy forms part of these Terms.
17. Governing law and disputes
These Terms and your use of the Service are governed by the laws of the Republic of Korea.
If a dispute arises we will try in good faith to resolve it with you. If court proceedings become necessary, the Seoul Central District Court shall be the court of first instance.
If you are a consumer, you may instead bring proceedings in the court for your domicile or residence under the Civil Procedure Act, and nothing in these Terms limits the rights the law gives you as a consumer.
Consumers may also apply for mediation to the Korea Consumer Agency (1372, www.kca.go.kr) or the Consumer Dispute Mediation Committee.
